TERMS OF USE

One Stop Racing terms of use for desktop website and mobile

These Terms of Use exist between you and One Stop Racing (operating under One Stop Digital Services Limited but hereafter referred to as One Stop Racing). By using One Stop Racing and by registering with One Stop Racing you agree to be bound by, and comply with, the Terms and Conditions herein.

Users must be over 18 years of age. One Stop Racing information is supplied for the exclusive use of the individual subscriber and must not be copied, reproduced, or distributed in any way without explicit permission in writing. Please read our full copyright notice below. Commercial users in any doubt about whether their current or intended usage infringes these terms should contact One Stop Racing for permission or clarification.

If we make significant changes to these Terms of Use we will take appropriate steps to bring such changes to your attention (such as by placing a notice of change in a prominent position at www.onestopracing.co.uk web site). It is your responsibility to check those Terms of Use from time to time to ensure you agree with them and your continued use of the One Stop Racing web site will be taken as your acceptance of any changes to the Terms of Use.

These terms were first introduced on 17th November 2021.

Fair usage

We operate a ‘fair usage’ policy and, while normal behaviour will not contravene this, excessive high-frequency calls, by any means, may result in suspension of access to onestopracing.co.uk. Consistent with our copyright policy below, data capture including, but not limited to, screen scraping is expressly prohibited.

Availability of services and the website

We will make every reasonable effort to ensure the desktop and/or mobile sites are continuously available and that interruptions to service will be kept to a minimum and, where possible, advertised in advance. Technical issues can happen, and we cannot be held liable for these. We do not promise that the website, products, or individual features will be always available or at specific times. There will be no right to compensation or refunds, in full or part, arising from interruptions to service or non-availability of products unless expressly covered elsewhere in these terms and conditions nor any liability accepted for losses, direct or implied, arising from the same.

Similarly, we cannot be held responsible for issues with the access arising from the customer’s own devices, email issues and so forth.

Registration

In order to access some content, and to make any purchase, you will need to be registered. There is no charge to register until a subscription is selected and you follow our checkout process.

To register you are required to complete all mandatory fields, including a permanent email address at which you can be contacted in the event of queries about your account. We do not accept registrations from email domains specifically designed to offer temporary mailboxes and, for security reasons, we reserve the right not to respond to account enquiries sent from different addresses. You may opt out of promotional emails at any time by contact form or using the unsubscribe feature at the end of any emails we send.

Certain services may not be available in certain countries due to regulatory conditions.

Account Management

We encourage users to manage their subscriptions, cancellations and access in their account created on our website.

It is the customer’s responsibility to inform us where changes need to be made to any details we may hold on them that they have previously provided.

Where accounts have had no live subscriptions, for a consecutive period of 3 months we may consider the accounts obsolete and delete the customer held information.

Promotions

Unless expressly stated, all promotional offers on One Stop Racing subscriptions, services, and goods, whether online or offline, are made on the basis of one claim per household, per subscription.

One Stop Race Cards

One Stop racing provide daily free race cards to all registered users. These are usually available by 4pm the day before the races. The cards are available online and may also have the option to download, for which you will need a PDF reader (such as Adobe) installed on your device. We cannot be held responsible for any technical issues causing a delay in publishing this data.

One Stop Systems

One Stop Systems are the property of One Stop Racing and must not be copied, shared or distributed elsewhere in any form. Any systems subscription purchased is intended for use by that user only and may not be copied, distributed or shared in any way (including in person, social media, email etc)

As a subscriber you expressly agree to these terms and conditions. Legal action will be taken if these systems are used in any of the aforementioned ways.

We cannot be held responsible for any technical issues causing a delay in publishing this data.

One Stop Ratings

One Stop Ratings are the property of One Stop Racing and must not be copied, shared or distributed elsewhere in any form. Any ratings subscription purchased is intended for use by that user only and may not be copied, distributed, or shared in any way (including in person, social media, email etc)

As a subscriber you expressly agree to these terms and conditions. Legal action will be taken if these systems are used in any of the aforementioned ways.

We cannot be held responsible for any technical issues causing a delay in publishing this data.

Recurring subscriptions

All our subscriptions are recurring subscriptions. This means that once you sign up to them payments will automatically be taken each month unless you cancel. We make it clear that all payments are recurring at the time you take out a subscription with us. We do not accept any responsibility for customers who claim they did not realise it was a recurring subscription and no refunds will be issued on such basis (see refund policy).

 Our subscriptions are recurring to ensure that your access to our ratings/systems is available without interruption each month.

Subsequent charges to your PayPal account (or debit/credit card depending on how you pay at the time of first sign up, will be made to the schedule implied at the time of purchase. For example:

  • If you take out a monthly subscription on 20th of the month the next payment will be charged to your PayPal/Bank account on 20th of the following month.

You can cancel your payment by logging into your account on our website or you can use the contact form

The same recurring charges apply regardless of how much racing takes place during the period covered by your payment.

Refunds and Cancellation Policy

No refunds, in part or in full, will be issued once a payment for a period has been processed. As per the above recurring subscriptions section, it is the customer’s responsibility to realise that this is a recurring subscription and action any request to cancel accordingly.

Subscriptions can be cancelled any time before the next payment is due although the customer should note the 3 working days’ notice required should they email us to request cancellation rather than action the cancellation in their own account on One Stop Racing. As subscriptions can be cancelled any time we DO NOT offer refunds once a payment has been processed under any circumstances.

We require a minimum of three (Monday- Friday excluding Bank Holidays) working days’ notice if you wish to cancel your recurring payment. If a payment is declined by your payment provider then access to One Stop Racing will be denied immediately.

Where payment regularly fails for the same customer or subscription, we reserve the right to refuse further transactions from said customer.

Updating Systems and Ratings

We constantly strive to improve our systems and ratings and therefore we may make changes at any time during your subscription. We will always do our best to make these changes clear and explain why they have been made but we are under no obligation to revert the changes upon customer request.

Links to other websites

Our website may contain links to other websites of interest. However, once you have used these links to leave our site, please note that we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this privacy statement. You should exercise caution and look at the privacy statement applicable to the website in question.

Copyright and Liability

Copyright in all One Stop Racing is strictly reserved by the Publishers and no material therein may be reproduced stored in a retrieval system or transmitted in any form or by any means electronic mechanical photo-copying recording or otherwise without written permission of One Stop Racing / One Stop Digital Services Limited. One Stop Racing information is supplied to the purchaser for their personal use and on the understanding that its contents are not disclosed.

Except where the purchaser is dealing as a consumer (as defined in the Unfair Contract Terms Act 1977 Section 12) all conditions warranties or terms relating to fitness for purpose merchantability or condition of the goods and whether implied by Statute Common Law or otherwise are excluded and no responsibility is accepted by the One Stop Racing Publishers for any loss whatsoever caused by any acts errors or omissions whether negligent or otherwise of the Publishers their Servants Agents or otherwise.

This Policy applies to our websites, application, products or services that link to this policy or do not have a separate privacy policy (collectively our “Services”).

This purpose of this privacy policy is to give you a better understanding of:

We collect information about you during the account registration process for any of our Services.   5. information and communications on forums on the websites including our social media channels
  6. Any emails, live chats or telephone calls you may have with us.
  7. your response to marketing campaigns from us or through our third parties i.e., open/click on such emails;

Third Party and Publicly Available Sources

Not all the personal information we hold about you will always come directly from you. We may also collect information from third parties such as our partners, service providers and publicly available websites (i.e. social media platforms), to comply with our legal and regulatory obligations, offer Services we think may be of interest, to help us maintain data accuracy and provide and enhance the Services.

If you log into one of our products through Facebook, Facebook provides us with some of your Facebook user details. We may use these details for the purposes of our registration process and to market our products and Services to you on Facebook.

Cookie Collection

We collect browser and cookie information when you first navigate to our websites. We use cookies to give you a better customer experience and for use of access. Certain cookies will allow you to leave and re-enter our Websites without re-entering your password. This will be monitored by a web server. How do we use this information

We process personal information for these Services- and business-related purposes:

One Stop Racing may, from time to time, retain trusted third parties to process your information to provide us with services globally, including for customer support, information technology, payments, sales, marketing, data analysis, research and surveys.

We will share personal information when we believe it is required, such as:

We are registered with the Data Protection Register, Registration number ZB273763 .

This privacy policy below further explains what data we hold, how we collect it and why we need it in relation to the onestopracing.co.uk website and services offered. You can also see your general rights in the information below.

Our legal basis for Processing your data:

Legitimate Interests – To provide the content/subscriptions and services related to horse racing as requested.

On the home page of our site, we ask for an email address, this is entirely optional but once an email address is given we will use this to send you information and offers on our services. We also ask for an email should you subscribe to any of our paid systems, ratings or content- this allows us to deliver the information to you and provide updates on your account.

 We may also send information on our products and services, and occasionally that of our carefully selected partners. All members of One Stop Racing remain on this list until they opt out of future mailings.

Sign up is via a double opt-in registration form, the data is held with Aweber, who also deal with unsubscribes and amendments via automatically generated footer links in each email we send. Double opt-in gives the customer the chance to change their mind to subscribing to our email list by ignoring the “confirm your email” opt- in.

Personal details required on joining our membership platform (for the provision of joining our ratings, system or content paid subscriptions) are provided so that we can service a customer’s membership. Personal information is recorded via our secure site, and the information is stored on a secure server.

We may also tag members on Aweber with certain descriptions ( e.g. annual ratings member etc) to allow us to service their account in a more personalised fashion. All terms when tagging customers on Aweber will only refer to either the advertising method via which they joined us or the type of subscription member they are, we will never use personal terms or descriptions to tag members.

Bookmaker affiliation- we may provide links for the customer to sign up to a bookmaker account to access a special offer of ours ( for example free ratings for a specific race or free ratings for the day). In this case we provide the website affiliate links to allow the customer to leave our site and join the bookmaker, for which (if they join the bookmaker via our site) we will receive a small renumeration, which allows or contributes to us providing our services. We have no control over the information provided to the bookmaker nor do we see the information provided by the customer to the bookmaker and their information will then be managed and controlled under the policies of the site that they join.

  • Access to personal data: You have a right to request a copy of the personal information that we hold about you. Should you wish to make such a request please contact us with the subject line “request to access personal data”. You should include adequate information to identify yourself and such other relevant information that will reasonably assist us in fulfilling your request. Your request will be dealt with as soon as possible.
  • Correction of personal data: You can request us to rectify and correct any personal data that we are processing about you which is incorrect. We provide you with account settings and tools to access the information associated with your account.
  • Right to withdraw consent: Where we have relied upon your consent to process your personal data, you have the right to withdraw that consent.
    To opt out of marketing, you can use the unsubscribe link found in the marketing communication you receive from us or you may contact us. We do our best to reply within 72 hours to such requests but at busy periods/annual leave this may take longer.
  • Right of erasure: You can request us to erase your personal data where there is no compelling reason to continue processing. This right only applies in certain circumstances, it is not a guaranteed or absolute right.
  • Right to data portability: This right allows you to obtain your personal data that you have provided to us with your consent or which was necessary for us to provide you with our products and services in a format which enables you to transfer that personal data to another organisation. You may have the right to have your personal data transferred by us directly to the other organisation, if this is technically feasible.

Other useful privacy & data security related matters

Retention 

We retain personal information for as long as we reasonably require it for legal or business purposes. If, having registered for any of our services, you do not use them for a reasonable time (which may vary depending on the service(s) you’ve registered for) we may contact you to ensure you’re still happy to receive communications from us.  We also reserve the right to delete the data where our services have not been used for a consecutive period of 3 months or more and where doing so does not contravene any other obligations or legal requirements.

Even if we delete your personal information it may persist on back-up or archival media for legal, tax or regulatory purposes.

Security

We recognise that online security and data protection is an area of vital importance for all our customers, so it is important to us that you have confidence in the security of your personal details before you register an account.  We will do our best to utilise the most up to date methods to ensure your security and data privacy.

As the security of some communications via the internet is not completely secure, we cannot guarantee the security of any information that you disclose using your internet connection. You accept the inherent security implications of using the internet and the One Stop Racing will accept no liability for any direct, consequential, incidental, indirect, or punitive losses or damages arising out of such an occurrence.
